"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
